Terms of Service

1 Acceptance of Terms

By registering an account, paying for a subscription, or accessing any part of the Aapna Vyapar platform, you confirm that:

• You are at least 18 years of age.
• You have the legal authority to enter into this agreement on behalf of yourself or your business.
• You have read, understood and agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use our service.

2 Description of Service

Aapna Vyapar is a cloud-based ERP (Enterprise Resource Planning) platform designed for wholesale textile businesses in India. The service includes:

• Order and invoice management
• Inventory and stock tracking
• Party ledger and outstanding management
• GST billing and e-Way bill support
• Payment tracking and receipts
• Business reports and analytics
• WhatsApp integration for communications
• Job work and mill tracking

We reserve the right to add, modify or remove features at any time. We will make reasonable efforts to notify you of significant changes.

3 Account Registration

To use Aapna Vyapar, you must create an account by providing your name, business name, email address and mobile number, and choosing a password. You agree to:

• Provide accurate and complete information during registration.
• Keep your password confidential and not share it with others.
• Notify us immediately at aapnavyapar@gmail.com if you suspect unauthorised access to your account.
• Be responsible for all activity that occurs under your account.

One website account can be linked to one ERP organisation. If you need additional organisations or users, please contact us.

4 Subscription Plans & Payments

Access to the ERP requires an active paid subscription. We offer three plans:

• All payments are processed securely through Razorpay. We do not store your card or UPI details.
• Subscriptions are not automatically renewed. You must manually renew before expiry to maintain uninterrupted access.
• Coupon codes, where provided, apply a discount to the plan price at the time of purchase.
• Prices are in Indian Rupees (INR) and inclusive of applicable taxes.
• We reserve the right to change plan pricing with reasonable advance notice to existing subscribers.

5 Refund Policy

Exceptions are considered on a case-by-case basis in the following circumstances:

• You were charged but ERP access was not activated due to a technical error on our side.
• Duplicate charges due to a payment processing error.

To raise a refund request, contact us within 48 hours of payment at aapnavyapar@gmail.com with your payment reference number. We will investigate and respond within 5 business days.

6 Your Data & Intellectual Property

Your data is yours. All business data you enter into the ERP — orders, parties, invoices, inventory, payments — remains your property at all times.

• You may request an export of your data at any time by contacting us.
• Upon account deletion, your data will be permanently removed from our systems within 30 days.

Our platform is ours. The Aapna Vyapar software, design, code, and brand are owned by us and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the platform during your active subscription.

You may not copy, resell, reverse-engineer, or create derivative works from any part of the Aapna Vyapar platform.

7 Acceptable Use

You agree to use Aapna Vyapar only for lawful business purposes. You must not:

• Use the platform to store or process illegal, fraudulent or counterfeit business transactions.
• Attempt to gain unauthorised access to any other user's account or our systems.
• Use automated scripts, bots or scrapers to access the platform.
• Interfere with or disrupt the platform's infrastructure.
• Share your account credentials with individuals outside your organisation.
• Use the service to violate any applicable Indian law, including GST regulations.

8 Service Availability

We aim to keep Aapna Vyapar available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted availability. Downtime may occur due to:

• Scheduled maintenance (we will notify you in advance where possible).
• Emergency fixes or security patches.
• Events beyond our control (force majeure, third-party outages, etc.).

We will make reasonable efforts to minimise disruption and restore service promptly. Planned maintenance is typically carried out during off-peak hours.

9 Limitation of Liability

To the maximum extent permitted by applicable law:

• Aapna Vyapar is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special or consequential damages arising from your use of the service.
• Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
• We are not responsible for errors in GST calculations, e-Way bills or any government filings made based on data entered into the platform. You are responsible for verifying all statutory submissions.

10 Termination

By you: You may stop using the service and request account deletion at any time by emailing us. Unused subscription time is not refundable.

By us: We may suspend or terminate your account if:

• You violate these Terms or our Acceptable Use policy.
• Your subscription expires and is not renewed.
• We detect fraudulent activity or abuse of the platform.
• We are required to do so by law.

On termination, your access to the ERP is immediately revoked. Where termination is at our discretion due to a policy violation, no refund will be issued. We will provide reasonable notice for terminations unrelated to policy violations.

11 Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of Aapna Vyapar shall be subject to the exclusive jurisdiction of the courts of India.

We encourage you to contact us first to resolve any dispute amicably before pursuing legal action.
